LEGAL CONDITIONS FOR PARTICIPATION IN THE CONTEST
1.- Habanos S.A., with fiscal address at Centro de Negocios de Miramar, Avenida 3ra entre 78 y 80, Edificio Habana, 3er Piso, municipality Playa, province Havana, Cuba, and e-mail festivaldelhabano@gmail.com is organising the contest (hereinafter, “the contest”), of international scope, to be implemented through Instagram. The purpose of this contest is to reward the followers of @habanos_oficial with two free tickets to the Gala Dinner of the 25th Edition of the Habano Festival to be held in February 2025.
2.-STARTING DATE AND CLOSING DATE
The competition will start on the 24th of January 2025 at 13.00h (Spanish time), and it will finalize on 28th of January 2025 at 23.59h (Spanish time).
3.- PARTICIPATION REQUIREMENTS AND MECHANICS OF THE CONTEST
The requirements for participation are:
- Those persons who are over 18 years of age will be eligible to participate.
- Those who have a public account on Instagram will be eligible to participate.
- Those users who follow the Habanos Instagram profile (@habanos_oficial) will be eligible to participate.
- Participants must comment on the Habanos, S.A. post on the social network Instagram by answering the question: what is the magic of Behike? And adding the hashtag #25FestivalHabano.
- Participation may be in English or Spanish.
- Participants may only participate with a single Instagram profile. If a participant is found to be participating with several Instagram profiles, they will be disqualified.
4.- CONDITIONS OF THE PROMOTION AND PRIZES
Habanos, S.A. will choose the winner based on their response: the most creative and the one that best reflects the essence of the Línea Behike (in addition to meeting the above requirements) will be the winner. The winner will be announced on January 31st through the social profiles of Habanos, S.A. The prize will consist of 2 tickets (one for the winner and a companion) for the Gala Dinner of the XXV Habanos Festival to be held in Cuba on February 28, 2025.
This prize does not include transportation or accommodation in Havana to attend the Festival and cannot be transferred to a third party.
The prize cannot be exchanged for cash or any other prize, nor can it be changed or altered. The winner will contact Habanos, S.A. through its Instagram Profile within 2 (two) days from the date on which it is announced on its social profile on the Instagram network (@habanos_oficial).
If no contact is made within the stipulated period, another winner will be chosen.
The winning contestant agrees that his/her username and profile photo (if applicable) may be published on the official channels of Habanos, S.A. (website www.habanos.com, Twitter and Instagram profiles or other websites of the organizer to announce the winners of the contest.
In said profiles and in relation to the contest or users as contestants, comments whose content is considered inappropriate, that are offensive, insulting or discriminatory or that could violate the rights of third parties will not be permitted. Habanos, S.A. reserves the right to delete said publications and disqualify participants who include offensive content.
5.- DISQUALIFICATIONS AND PENALTIES
If it becomes evident that any of the Participants do not comply with the requirements set forth in the Rules, or the data provided to participate are not valid, their participation will be considered null and void and they will be automatically excluded from the contest and will lose all rights to the prizes awarded under this contest.
6.- PUBLICATION OF COMMENTS OR OPINIONS
Comments or opinions whose content is considered inappropriate, offensive, insulting or discriminatory or which could infringe the rights of third parties will not be allowed. Comments against an individual that violate the principles of the right to honour, to personal and family privacy, and to one’s own image will not be allowed. Habanos, S.A. shall not be liable for any damage caused by comments made by Participants in the competition that may offend the sensibilities of other Participants.
Participation in this competition, as well as the publication of the comments made by Participants in the publications, may not under any circumstances violate the Instagram Community Rules or the Instagram Terms of Use. If the Company is found to have used fraudulent means to participate, such as the use of bots in the comments, the prize will not be awarded and will remain the property of the Company.
7.- EXONERATION OF RESPONSIBILITY
By way of example, but not limited to, Habanos, S.A. is not responsible for delays or any other circumstance attributable to third parties that may affect the development of the contest, nor for the use made by the Participant in relation to the prize that he/she obtains from this contest.
Habanos, S.A. assumes no responsibility in the event of force majeure or unforeseen circumstances that may prevent the contest from being held or the total or partial enjoyment of the prize. In the event that the contest cannot be executed, either due to fraud detected in the contest, technical errors, or any other reason that is not under the control of Habanos, S.A. and that affects the normal development of the contest, we reserve the right to cancel, modify, or suspend the contest, including the participation web page
8- PROTECTION OF PERSONAL DATA
he Company responsible for the processing of your data is Habanos, S.A. [with address in Havana, Cuba and identification number 32000364711]. In accordance with the provisions of Law No. 149 and the Regulation for the Security and Protection of Personal Data, each participant, by accepting these Legal Bases, consents to their personal data being incorporated into a file, for the purpose of managing the competition, as well as disseminating and publicising its results, and processing the awarding of the Prize.
In the event that you consider that your personal data has not been processed in accordance with the regulations, or that the exercise of your rights has been infringed, you may file a complaint by sending an e-mail to the following address: festivaldelhabano@gmail.com or by sending a letter to the following address: Centro de Negocios de Miramar, Avenida 3ra entre 78 y 80, Edificio Habana, 3er Piso, municipality Playa, province La Habana, Cuba, enclosing in both cases a copy of an identification document.
The Participant declares that he/she has been informed of the conditions on personal data protection and accepts and consents to the processing of his/her personal data.
9.- CHANGES AND ACCEPTANCE
Habanos, S.A. reserves the right to modify or extend these promotional terms and conditions, to the extent that it does not prejudice or undermine the rights of the participants in the contest.
The mere fact of participating in the contest implies that the participant fully accepts the conditions set out above.
